EIRE AND FOREIGN PAYMENTS

Payments from the Republic of Ireland and from overseas must be made in Sterling or Euro.

Your rental period is from 6 pm on the day you arrive until 10 am on the day you depart.  This is to give us time to clean and prepare the property for when you arrive and for the people coming after you.

In exceptional circumstances we may agree to allow you to stay longer by prior agreement.  This will depend on whether the property is let immediately before or after you contract period.  We reserve the right to cancel any such agreement up to 24 hours before you arrive (if you want to arrive early) or 24 hours before you depart (if you want to stay longer) to clean and prepare the property or to carry out repairs.

Our agent will meet you at the villa to provide keys and show you the villa and how to operate the facilities.  He will be at the villa for 1 hour from 6pm or from your agreed arrival time.  If you arrive later you will be charged 25 Euro plus a further 25 Euro for each hour or part hour you are late.  If you will not arrive on time and contact our agent at least one hour before the agreed meeting time, this charge may be waived by agreement with our agent.


You are asked to help us by:
Keeping the pool free of leaves and debris. Keeping the house clean and tidy, just like your own home. Allowing reasonable access for our agent to maintain the pool and garden.

A few do's and don't's

  • Do relax and enjoy yourselves
  • Do use plastic glasses and crockery outside.  Broken glass in the swimming pool will mean it will have to be closed for cleaning.  It will spoil your holiday and the cost will have to be deducted from your security deposit.
  • Do shower before using the pool it helps keep the water quality good and means we don't need to use as much chlorine making your swim much more pleasant.
  • Do ensure children are supervised at all times.  The pool is 1.75 metres deep and well over the head of most young children.
  • Do remember not to dive into the pool.  At 1.75m the pool is not deep enough to dive safely.  Use of the pool at your own risk.
  • Do remember we have a septic tank so please be careful what you put down the drains and toilets.
  • DO NOT hit your head on the living room chandelier - it hangs quite low and if you are over 6' (1.8m) you may catch it.
  • Don't forget to leave the property clean and tidy as additional cleaning charges will be deducted from your security deposit.
  • Don't forget to remove all perishable food from the villa.
  • Do agree the inventory and breakages with our agent before you leave.
  • Don't bring your pet.  We do not allow pets and your pets will probably have a much better holiday at a professional kennel or cattery
  • Do use the internet responsibly:  Our internet provider has a fair use policy, in the event that excessive data downloading occurs they may restrict the service.  In addition, the router should not be touched, any service calls to the internet provider which are the result of guests tampering with the connection and setup will be charged to you.



The following booking conditions together with Holiday Information, Pricing Information & How To Book Your Holiday on our website form the basis of the contract between you and us as the accommodation providers. If you are in doubt about any of these conditions or need further clarification please contact us at Info@costa-luz.com.

This contract is for the rental of Casa Alhambra, 2 Camino del Vinagre, Chiclana de la Frontera, Spain.  The rental period is from 4pm on the day of arrival to 10 am on the day of departure.  The dates are as specified on our invoice.

All contracts are entered into are with the person named on our invoice.  References to "you", “your” and "yours" are references to the person named on our invoice unless otherwise stated. "We" and "Us" are references to Ashley & Philip Spinks, the accommodation providers or their agents.  Your contract is with Ashley & Philip Spinks.

The do and don'ts above are also part of the terms and conditions.

Once you have confirmed your booking you shall be deemed to have read and understood the terms and conditions contained below.

1.         The Contract between Us

When you make your booking you are accepting these booking conditions and information referred to above on behalf of all the persons named on the booking.  Any information or conditions set out in booking offer documents (including email) or indicated on our website also form part of the agreement.  Your contract with us comes into existence when we issue our confirmation invoice and we have received your deposit in cleared funds.  It is your responsibility to check that the details on your confirmation invoice are correct.  We will accept no responsibility if you do not inform us of any discrepancies within 7 days of the issue of the confirmation invoice.

2.         Paying For Your Holiday

You are required to pay a 30% deposit at the time of booking.  The balance must be paid at least 8 weeks before your departure date.  We reserve the right to amend reasonably the price of your booking after you have booked but no later than 30 days prior to departure.  If the full holiday cost is not paid or not paid on time, we have the right to treat your booking as cancelled by you. In this case, the cancellation charges shown under "IF YOU CANCEL YOUR HOLIDAY” will be payable.

3.         If You Change Your Booking

If, after our confirmation invoice has been issued, you wish to change the booking in any way, we will do our utmost to make the changes, but it may not always be possible.  If one party withdraws from the holiday, someone else can take their place providing they satisfy the conditions of the original booking and you inform us at least 14 days before departure.  An administration charge may be applied.

4.         If You Cancel Your Holiday

To cancel your booking, you must provide us with notice in writing.  Cancellation takes effect on the date we receive the notice.  We ask that you provide as much notice as possible.  The following cancellation charges apply:-

5.         If We Change Your Holiday

Occasionally, we may have to make changes both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so.  We will notify you as soon as possible and allow you 7 days to either accept or cancel the booking.

If you accept alternative arrangements from us and the alternative is less expensive, we will refund the difference, but if they are more expensive you will have to pay the difference.  In all cases, our liability for changes and cancellations is limited to offering you a full refund of your monies paid.  We regret that we cannot pay expenses, costs or losses incurred by you as a result of any change or cancellation or by any force majeure event (such as threats of war, civil strife, industrial disputes, terrorist activity, fire, airport closures, adverse weather conditions and similar events beyond our control).

In the event you do not accept the alternative arrangements you may cancel the booking and we will make a full refund of all monies paid to us.  This will discharge all our liabilities to you.

6.         Arrivals and Departures at the Villa

Changeover is Saturday unless otherwise agreed in writing.  The property will be available to you from 6:00 p.m. on the day of arrival and you will be required to vacate the property by 10:00 a.m. on the day of departure.  Late departures may be charged for an extra day, deductible from your security deposit.  These times can vary subject to prior agreement with us.

If you wish to arrive outside of normal business hours you must indicate this on booking.  An additional charge for out of hours arrival will be levied.

Our agent will meet you at the villa to provide keys and show you the villa and how to operate the facilities.  He will be at the villa for 1 hour from 6pm or from your agreed arrival time.  If you arrive later you will be charged 20 Euro plus a further 20 Euro for each hour or part hour you are late.  If you will not arrive on time and contact our agent at least one hour before the agreed meeting time, this charge may be waived by agreement with our agent.

On arrival, you are required to check the accommodation inventory and agree your acceptance of the property’s contents and condition.

On departure you are required to check the property inventory with the agent and agree the property’s contents, condition and any breakages. Checking out may take some time so please allow sufficient time for this in the planning of your itinerary.

Advance notice of your departure time must be given to the agent/owner.

7.         Directions and Contact Details of Our Agent

We will provide to you detailed directions to the property and contact details for our agent after receiving your final payment.  Changes to road layouts are beyond our control.  We will endeavour to ensure that the directions we give you are as accurate as possible.

8.         Your Accommodation

The villa is reserved exclusively for you and those listed by you on booking.  No other persons are permitted to stay at the property unless agreed by us in writing.  Should you experience a problem with the property you must inform our agent or us immediately.  The website description of the property and the facilities available are subjective and open to interpretation and we reserve the right to withdraw a facility temporarily or otherwise.

Care of the property - you must keep the premises and all the furniture, fixtures, fittings and effects in the same state of repair and condition as at the commencement of your stay, subject to reasonable wear and tear.

Cleaning - If you are unhappy with the cleanliness of the property please advise our agent immediately.  You should leave the property clean, tidy and remove any perishable items.  The cost of your holiday includes the cost of reasonable cleaning at the end of your holiday.  If the villa is left in a condition that requires additional cleaning, over and above what is normal, an extra charge will be incurred and deducted from your security deposit.

Linen/towels - All bed linen and indoor towels are provided. Towels for use around the pool or for the beach are not provided.

Cots and High Chairs – these may be made available for a small additional daily charge.  Enquire at the time of booking.

Unreasonable behaviour - at all times during your holiday, you are expected to be considerate.  As such, we reserve the right to ask you to leave the property at any time should your behaviour be such that we feel we can no longer accommodate you.  In this instance, we will offer no refunds nor be responsible for any nights lost accommodation or expenses incurred.  We will also hold you and members of your party jointly responsible for any damage to the property, together with legal costs incurred pursuing the claim.  We cannot accept responsibility for the behaviour of neighbours, individuals or others who have no connection with your holiday.

Pets - we regret that pets are not permitted at the property unless by prior agreement.    If you bring a pet without agreement we reserve the right to refuse admittance and you will forfeit your deposit and/or security deposit.

Access - We reserve the right to enter the property during your stay at a responsible time on reasonable cause.

Pool - the swimming pool is not heated.  Activities around the pool must be appropriately supervised, particularly where children are staying at the property.  The pool has steps from the poolside leading into the pool.

USE OF THE SWIMMING POOL IS ENTIRELY AT YOUR OWN RISK. DIVING IS NOT PERMITTED.

Kitchen equipment - Plastic plates, cups and glasses are provided in the kitchen and we request that these be used around the pool area to ensure that the pool and surrounding area is free from any sharp objects liable to cause injury.

Heating - the property has a wood burning fire with a glass safety door.  You must use the fire responsibly and ensure that it is safe and guarded at all times.  You are required to provide wood should you use this facility and its use is entirely at your own risk.  Any damage sustained to the property through the negligent use of the fire will either be deducted from your security deposit or subsequently invoiced to you depending on the extent of the damage incurred.

TOOLS PROVIDED FOR CUTTING WOOD ARE USED ENTIRELY AT YOUR OWN RISK

Signs - throughout the property we ask that you observe the signs posted so as to ensure a safe and trouble-free holiday.  For example, please do not place nappies or sanitary towels down the toilet or acidic items on the worktops.

Safety - You are asked to act responsibly at all times.  For example, do not use glass or crockery near the swimming pool as any breakages are dangerous, will lead to the pool being closed and you will be asked to pay for the cleaning costs; do not dive into the pool as the pool is 1.75m deep and is not deep enough to dive safely; use the fire responsibly.  This is not an exhaustive list.

Power - Electricity supplies in this area are erratic.  To ensure that your holiday is not spoilt by power cuts the property is fitted with a state-of-the-art, fully automated, self-contained electricity supply.  We designed this system so that you can use the appliances as if there was a normal local mains supply, however, as would happen at home, if you overload the supply the system will fuse. To avoid this, the system is designed to shut down and restart itself in the event of too much load.  The restart procedure only takes a few seconds.  Our agent will provide some simple rules for you to follow when you arrive to avoid this happening, such as not operating the washing machine and the dishwasher at the same time.  The power supply is 230V.

If the system does not automatically reset after 15 minutes, contact our agent who will arrange for maintenance.  If the power outage cannot be repaired within 24 hours, we will endeavour to find suitable alternative accommodation.  Should you decide to accept alternative accommodation; the cost of such accommodation will be met by you the client and we will undertake to separately reimburse you for any unused nights of accommodation at Casa de Alhambra.  Such reimbursement will be prorated.  The amount due will be calculated by dividing the amount you paid by the number of nights booked and multiplying by the number of nights you have not used.  Reimbursement will be paid in the currency in which you booked your holiday and limited to the amount you paid.  Any deviation from this policy will be entirely at our discretion.

Insurance - Adequate insurance is essential and it is your responsibility to arrange personal travel and medical insurance to meet your requirements for your holiday.

Burglary or theft - It is your responsibility to ensure the property is secured at all times during your stay and that all doors, windows and gates are secured when away from the property.  Any damage sustained as a result of your failure to appropriately secure the property during your stay will be your responsibility and you will be invoiced for any resulting damage or loss of property.

8.         Security Deposits

Security deposits will be required and must be paid with the final invoice payment, unless otherwise agreed. We reserve the right to deduct any losses, breakages or damages caused during your stay and the cost of extra cleaning if the property is left in an unreasonable state. Should the security deposit be inadequate to cover any charges made, it is a condition of booking that you pay any balances due within 14 days of being notified of excess charges.

The security deposit will be GBP 200 or varied by agreement. This sum is shown on your final invoice. The deposit will be banked in all cases. The security deposit will normally be refunded within 28 days of you leaving the property, less any deductions, upon confirmation from the local agent that the property was left in a satisfactory condition.  It is not possible to fully inspect the whole villa on departure and we reserve the right to require additional payment from you should additional damage be identified after your departure.

9.         If You Have A Complaint Or Problems With The Accommodation

In the unlikely event that you experience a problem with your accommodation, the Accommodation Agent/Owner must be contacted as soon as possible to give them the opportunity to resolve the problem to your satisfaction.

If you have a complaint please write to us within 21 days of the last day of your holiday giving your original booking reference and all relevant information.

10.       Accuracy

Ensuring information about Casa Alhambra is accurate is as important to us as to our clients.  Every effort is made to ensure the accuracy of the website and prices at the time of publishing, although we cannot accept liability for any misdirection that is out of our control.  Regrettably, there may be occasions when facilities are not available and errors do occasionally occur. You must therefore, ensure you check all details with us directly at the time of booking.

11.       Lost Property

Please check your accommodation thoroughly before departure. If you leave anything, you must advise us immediately and we will endeavour to retrieve the lost articles, subject to a minimum charge of GBP 50. Please note we cannot guarantee to locate and return lost items and cannot be responsible for any property you have left in the property.

12.       Our Liability to You

We do not accept liability arising from death, personal injury or illness.  We are not held responsible for any loss or damage to personal possessions during your stay.  We do not accept liability for any third party claim, accident, damage or loss to you or your property or for any expenses incurred for any reason.

13.       Distance and Maps

The accommodation is a short distance from Novo Sancti Petri.  Any maps or information provided is to assist you locating the property.  We cannot be responsible for the accuracy of the information given or for you not being able to find the property.  Times given may be affected by traffic, driving and weather conditions.  The information is given as a guide only.

14.       Legal Jurisdiction

This contract is made on the terms of these booking conditions which are governed by English Law and both parties shall submit to the jurisdiction of the English Courts at all times.


Concessions to Spanish life may be needed when travelling in Spain. It is worth having a good Spanish phrase book with you, as English is not always widely spoken.  A good deal of patience may be required in order to understand what the other party is saying.

Our property is occupied mainly during the summer months and is equipped for holiday living, it may not be full of the luxuries you have become accustomed to in your own home. The house is shut up during the winter months and therefore may appear 'musty' on arrival. Concessions may have to be made for our personal taste and lifestyles. The furniture and the decor may not be to your taste and the mattresses may not be as comfortable as your own.

Cooking utensils are different. Our bedrooms have tiled floors instead of carpets, and shutters a well as curtains.

In hotter climates and semi-rural areas you may find a greater number of insects and animals than you would at home. Farmyard smells and insects are normal in rural areas and you may be woken early by the crowing of a cockerel or farm tractor. Please remember that any tourist region is constantly under development and that you may be affected by this.

STANDARDS

The Spanish have different standards in terms of electrical fittings, plumbing, ventilation and building standards, however they all conform to the Spanish local building requirements and Spanish national regulations.  

In certain respects, local national safety standards may be lower than those of other countries.  Liability insurance requirements vary and may be different to your own country, as may the responsibility placed on us by law. We would advise therefore that you take all reasonable precautions to protect yourself and your family whilst on holiday.

Passports and Visas - A valid passport is required for Spain. Visas are not required for EU passport holders, however if you hold a non-EU passport you may require a visa and this can take more than 8 weeks to obtain. Please enquire at your nearest Spanish Consulate for details. We will not be responsible for any consequences arising if you fail to travel without proper documentation.

Health and Vaccinations - No vaccinations are currently required for British or EU citizens visiting Spain or Portugal. Visitors from other countries should check with their nearest Consulate. Your local Post Office or DSS office will have available a leaflet which gives important information regarding health and medical matters.

Travel and Flight Information – (1) Pregnancy - Regulations vary from airline to airline, but some will refuse to carry women who will be 28 weeks or more pregnant on the date of travel. Check with your airline and consult your own doctor.

(2) At the Airport - You must check in at least 2 hours before your flight is scheduled to take off. If you fail to check in on time, the airline is entitled to refuse to allow you to board the flight.  If travelling by sea check with your operator

In the event of any delay, you must make your own arrangements for meals and accommodation if required. Casa Alhambra Holidays does not provide these for you. No refunds will be given for accommodation nights not used due to travel delays.

OUT OF SEASON HOLIDAYS

The benefits of taking a holiday outside the peak July/August period are many. Resorts are quieter and roads are less crowded. However, there will be fewer facilities available in your resort and this is reflected in the price.

SPECIAL REQUESTS

We cannot guarantee to accommodate special requests however if the request is reasonable we will try to comply with your request.  Additional terms and conditions may apply.

ACCOMMODATION INFORMATION

Gas:
Bottled gas is used for cooking and heating water. Replacement bottles can be obtained nearby at Venta Lopez or most service stations. Please replace by taking the empty cylinder and buying a replacement.  The cost of gas is approximately Euro 12 per bottle.  This price may vary.

Local representation: A local agent looks after the property who speaks English. Your contact will be shown on your booking confirmation and directions.  They will meet you at the property to show you around and provide keys.

Living/dining room: A room for daily living.

Kitchen:
The kitchen is adequately equipped and contains a dining table and chairs.

Television:
This offers Spanish Channels and satellite channels. Satellite TV does not necessarily mean that you will have access to channels in your own language.

Telephone:
There is no telephone in the property.

Bedrooms:
All bedrooms have full sized beds. The lounge has a sofa bed.

Bathrooms:
Room with bath, hand basin, WC and bidet. The property has a septic tank.

Linen and towels:
Duvets and pillows are provided for the number of beds indicated. Linen and towels are provided for use in the house.  Towels for use around the pool and beach are not provided and you should provide your own.

Garden:
The chalet has a private secluded garden for the sole use of the occupants.  Access is required to the property or grounds for maintenance purposes (garden, swimming pool, etc). Whilst the garden is enclosed this does not imply that children can play unsupervised.

Beaches:
Beaches refer to the sea and are sandy.
